TERMS AND CONDITIONS OF SALE

1. Seller information

The ProWorksite website and its online store are operated by:

In these terms, ProWorksite di Rasbici Federico is also referred to as “ProWorksite”, the “seller” or the “trader”.

2. Purpose and scope

These terms govern the online sale of products available on the ProWorksite website and form an integral part of every contract concluded through the online store.

Before placing an order, the customer is advised to read carefully:

  • these terms and conditions of sale;
  • the Shipping page;
  • the Returns and Refunds page;
  • the Warranty page;
  • the Privacy Policy;
  • any applicable Cookie Policy;
  • the description and specific conditions of the product purchased.

By submitting an order, the customer confirms that they have read and accepted the applicable terms made available before the purchase was concluded.

These terms do not limit any mandatory rights granted to consumers under Italian and European law.

3. Definitions

“Customer” means the natural or legal person who purchases one or more products through the website.

“Consumer” means a natural person who purchases for purposes unrelated to their business, trade, craft or professional activity.

“Business customer” or “professional” means a party purchasing in the course of their business, trade, craft or professional activity, including by using a VAT number.

Provisions expressly identified as consumer rights do not automatically apply to business customers.

4. Requirements for placing an order

To place an order, the customer must:

  • be at least 18 years old or otherwise have the legal capacity to enter into the contract;
  • provide complete, accurate and up-to-date information;
  • use a valid and authorised payment method;
  • provide an address at which delivery can be properly completed;
  • not use the website for fraudulent, unlawful or unauthorised purposes.

The customer is responsible for the accuracy of the information entered during checkout.

5. Products sold

ProWorksite sells tools, equipment, batteries, chargers, accessories and other products intended primarily for professional or technical use.

The website may offer:

  • new products;
  • used products;
  • refurbished products;
  • reconditioned products;
  • products that have previously been used;
  • products sold with or without their original packaging;
  • products supplied with accessories that vary according to the individual offer.

The product’s actual condition is stated on the relevant product page.

Before purchasing, the customer must carefully check:

  • brand and model;
  • product condition;
  • items included;
  • whether a battery and charger are included;
  • technical specifications;
  • compatibility;
  • any disclosed cosmetic defects;
  • warranty terms;
  • product images and description.

6. Used and refurbished products

Used or refurbished products may show normal cosmetic signs of previous use, such as scratches, discolouration, minor impacts, marks on handles or surface imperfections.

Where these characteristics are stated in the description or clearly visible in the photographs, they form part of the product condition accepted by the customer and do not automatically constitute a lack of conformity.

Depending on the product, refurbishment may include:

  • cleaning;
  • a general inspection;
  • an operational check;
  • testing of the main functions;
  • repairs where required;
  • replacement of components where required;
  • preparation for resale.

Refurbishment does not necessarily make the product cosmetically equivalent to a new item.

Photographs must be considered together with the description. If there is a material inconsistency, the customer is advised to request clarification before purchasing.

7. Images and descriptions

ProWorksite endeavours to represent products as accurately as possible.

The appearance of colours, finishes and details may vary depending on:

  • the device used;
  • screen brightness;
  • browser settings;
  • the lighting conditions when the photograph was taken;
  • image processing and compression.

These variations do not justify substantial differences from the stated characteristics.

Any clerical errors in descriptions, prices or images will be corrected as soon as they are identified.

8. Product availability

Availability shown on the website is updated with the utmost care, but a product may subsequently become unavailable due, for example, to:

  • simultaneous orders;
  • an inventory error;
  • damage to the product before shipment;
  • a failed final inspection;
  • a technical platform error.

If an ordered product is no longer available, ProWorksite will inform the customer and, where possible, offer:

  • an equivalent product;
  • the option to wait until the product is available again;
  • a change to the order;
  • cancellation of the unavailable product;
  • a refund of the amount paid.

No substitution will be made without the customer’s consent.

9. Purchasing procedure

To make a purchase, the customer selects the product, adds it to the cart and completes checkout by entering the required information.

Before submitting the order, the customer can review:

  • the selected products;
  • quantities;
  • price;
  • any discounts;
  • shipping costs;
  • the delivery address;
  • billing information;
  • the payment method;
  • the total amount.

The customer must correct any errors before confirming the purchase.

Pre-contractual information must be presented clearly and must include the product’s main characteristics, the total price, additional charges, the seller’s identity and the payment and delivery methods.

10. Conclusion of the contract

Submitting the order constitutes an offer to purchase by the customer.

The contract is concluded when the customer receives ProWorksite’s order confirmation, subject to successful payment and any security checks.

The confirmation is normally sent to the email address provided by the customer and contains or refers to the main information relating to the purchase.

The customer must check the confirmation and promptly report any errors.

ProWorksite may refuse or cancel an order only for justified reasons, such as:

  • the product being unavailable;
  • payment being declined or not completed;
  • reasonable suspicion of fraud;
  • an obvious error in the price or description;
  • inability to complete delivery;
  • a breach of these terms;
  • an order placed for unlawful purposes.

If an order that has already been paid for is not accepted, the amounts received will be refunded.

11. Prices

The applicable prices are those displayed on the website and confirmed at checkout when the order is placed.

Before confirmation, the customer is shown the total price, including:

  • applicable taxes;
  • shipping costs;
  • any additional charges;
  • discounts and promotions;
  • the total amount payable.

No additional charge will be applied without the customer’s consent.

In the event of an obvious and recognisable pricing error, ProWorksite will contact the customer before proceeding. The customer may confirm the purchase at the correct price or cancel the order and receive a refund.

12. Discount codes and promotions

Discount codes and promotions are subject to the conditions stated when they are published.

Unless otherwise stated, they:

  • cannot be exchanged for cash;
  • cannot be combined;
  • cannot be applied after the order has been concluded;
  • may have an expiry date;
  • may be limited to specific products, customers or order values;
  • may be suspended in the event of improper or fraudulent use.

In the event of a return, the refund is calculated on the amount actually paid for the product.

Where a return changes the eligibility requirements for a promotion applied to the entire order, the refund may be recalculated in accordance with the original terms of the offer and applicable law.

13. Payment methods

The customer may use only the payment methods displayed during checkout.

Depending on the country, device and amount, the following may be available:

  • American Express;
  • Apple Pay;
  • Google Pay;
  • Klarna;
  • Maestro;
  • Mastercard;
  • PayPal;
  • Shop Pay;
  • UnionPay;
  • Visa;
  • any other systems displayed at checkout.

Cash on delivery is not available.

The actual availability of each method depends on the relevant provider’s terms.

14. Payment security

Payments are processed through Shopify and the payment providers available at checkout.

ProWorksite does not intentionally store the full card number or CVV security code.

The payment provider may require:

  • 3D Secure authentication;
  • confirmation through a banking app;
  • a one-time code;
  • identity verification;
  • anti-fraud checks;
  • additional authorisations.

ProWorksite is not responsible for a transaction being declined by the bank, card network or payment provider.

15. Payments with Klarna or other instalment services

When the customer selects Klarna or another deferred or instalment payment service, the financing or deferred-payment agreement is managed directly by the relevant provider.

The provider may:

  • verify the customer’s identity;
  • carry out risk assessments;
  • approve or decline the application;
  • set deadlines and conditions;
  • manage late payments and recovery of amounts due.

ProWorksite does not decide whether deferred payment is approved and cannot change the conditions imposed by the provider.

16. Electronic invoicing

ProWorksite issues an electronic invoice when requested or required under applicable law.

Customers requiring an invoice must provide accurate and complete information, such as:

  • first and last name or company name;
  • address;
  • tax code;
  • VAT number;
  • recipient code;
  • certified email address (PEC);
  • any other required tax information.

The information must be provided before the invoice is issued.

The customer is responsible for the accuracy of the tax information supplied. Once the document has been issued, certain changes may require specific tax procedures or may no longer be possible.

17. Order preparation

Orders for products in stock are normally prepared within one business day after payment is confirmed.

Preparation times may be longer in the event of:

  • orders placed during public holidays or weekends;
  • additional technical checks;
  • heavy or bulky products;
  • a high volume of orders;
  • technical problems;
  • requests for changes;
  • events that are not reasonably within ProWorksite’s control.

The stated preparation time does not include the time required by the carrier to complete delivery.

18. Shipping

Shipments are normally entrusted to BRT.

Available destinations and the applicable costs are shown during checkout.

Under the terms currently applied:

  • standard shipping within Italy is included, except for optional services;
  • standard shipping to enabled European Union countries may cost €7.99;
  • for other destinations, availability and cost are shown at checkout.

In the event of any difference, the cost and conditions displayed to the customer before payment always prevail.

19. Delivery times

Delivery is normally estimated within 24–48 business hours after the parcel is handed over to the carrier.

The stated times are estimates and may be affected by:

  • remote, island or mountain destinations;
  • weather conditions;
  • strikes;
  • public holidays;
  • high shipment volumes;
  • customs checks;
  • carrier system outages;
  • incorrect or incomplete addresses;
  • force majeure events.

For consumers, unless a different deadline has been agreed, delivery must in all cases take place without undue delay and no later than 30 days after the contract is concluded. If the seller does not deliver within the applicable period, the consumer may grant an additional reasonable period and, if delivery is still not completed, terminate the contract in the circumstances provided by law.

20. Tracking

When available, the tracking number is sent by email or made available through the website or the carrier’s systems.

It may take several hours before tracking shows the first updates.

An order may be divided into several parcels or shipments without additional charges where ProWorksite decides to split the order.

21. Delivery address

The customer must correctly provide:

  • the recipient’s name;
  • address;
  • the street number;
  • the postcode;
  • the city;
  • the province;
  • the country;
  • the telephone number;
  • any information required by the carrier.

Requests for changes must be communicated as soon as possible and preferably within 12 hours of placing the order.

A change cannot be guaranteed once the parcel has been prepared or handed over to the carrier.

If a parcel is returned because of an error in the information supplied by the customer, ProWorksite may request payment of the actual costs required for a new shipment after communicating the amount in advance.

22. Failed delivery and parcel holding

If the recipient is absent, the address is incomplete or delivery cannot be completed, the carrier may:

  • make another delivery attempt;
  • contact the customer;
  • hold the parcel at a depot;
  • return the parcel to ProWorksite.

The customer must check tracking and follow the instructions received.

Failure to collect or refusal of delivery does not automatically replace the notice required to exercise the right of withdrawal.

23. Risk during transport

Where the customer is a consumer and transport is arranged by ProWorksite, the risk of loss or damage remains with the seller until the goods are physically delivered to the consumer or to a third party designated by the consumer.

The risk passes to the consumer earlier only where the consumer independently appoints a carrier not offered by ProWorksite.

24. Damaged parcel

At the time of delivery, the customer is advised to check:

  • the integrity of the packaging;
  • for any impacts or openings;
  • for any signs of moisture;
  • the number of parcels;
  • for any signs of tampering.

Where visible irregularities are present, customers are advised to accept the parcel subject to a specific written reservation describing the damage.

The customer is advised to contact ProWorksite preferably within 24 hours and provide photographs of the parcel, shipping label and product.

Prompt notification makes checks with BRT easier, but does not limit the consumer’s mandatory rights.

25. Cancellation before shipment

The customer may request cancellation of an order by contacting ProWorksite promptly.

Cancellation cannot be guaranteed once the product has been prepared or handed over to the carrier.

Where the order can no longer be cancelled, the consumer may exercise the right of withdrawal after delivery in accordance with the applicable terms.

26. Right of withdrawal

A consumer may withdraw from the purchase within 14 days of delivery of the product without providing a reason.

Where several products are delivered separately, the period begins when the last product or parcel is received.

To exercise the right of withdrawal, the consumer must send a clear notice to:

The notice should state:

  • first and last name;
  • the order number;
  • the product being returned;
  • the date received;
  • the customer’s contact details.

The 14-day right of withdrawal normally applies to online purchases concluded by consumers.

27. Return after withdrawal

After giving notice of withdrawal, the consumer must return the product within 14 days to the following address:

The shipment must be appropriate for the product’s value, weight and dimensions.

The customer must retain proof of shipment until the procedure has been completed.

Parcels must not be sent cash on delivery or with charges payable by the recipient unless agreed in writing with ProWorksite.

28. Return costs for a change of mind

Where withdrawal is due to a simple change of mind, the direct return costs are borne by the consumer.

For heavy or bulky products, the cost may depend on weight, dimensions, collection location and the carrier’s tariff.

Return costs are not borne by the consumer where the product is defective, non-conforming, different from the item ordered or damaged during transport arranged by ProWorksite.

29. Condition of the returned product

The consumer may inspect the product to the extent necessary to establish its nature, characteristics and operation.

The product must be returned:

  • adequately protected;
  • complete with all parts received;
  • with the batteries, chargers and accessories included in the order;
  • preferably in its original packaging, where available;
  • without unauthorised modifications or work.

The absence of the original packaging does not automatically remove the right of withdrawal.

The consumer may be liable for any reduction in value caused by handling beyond what is necessary to inspect the product.

30. Refund following withdrawal

In the event of a valid withdrawal, ProWorksite refunds:

  • the price actually paid for the product;
  • the original standard delivery cost, where applicable;
  • any other amounts that must be returned under applicable law.

Any additional costs arising from the choice of a delivery method more expensive than standard delivery will not be refunded.

The refund will be issued within 14 days of notification of withdrawal.

ProWorksite may withhold it until the product is received or until proof of shipment is supplied, whichever occurs first.

The refund will be made using the same method used for payment, unless otherwise agreed.

The time required for the credit to appear also depends on the bank or payment provider.

31. Exceptions to the right of withdrawal

The right of withdrawal may be excluded in the cases provided by law, including, where applicable:

  • made-to-measure products;
  • clearly personalised products;
  • goods which, after delivery, become inseparably mixed with other goods;
  • sealed software or content opened after delivery;
  • other products or services expressly excluded by law.

Any applicable exclusion will be communicated before the purchase is concluded.

32. Legal guarantee of conformity

Consumers benefit from the statutory guarantee of conformity provided by applicable law.

For new products, the seller’s liability normally lasts for two years from delivery.

For used or refurbished products, ProWorksite and the consumer agree on a period of 12 months from delivery where this condition is clearly stated on the product page and accepted at the time of purchase.

The law permits a shorter period to be agreed for used goods than for new goods, provided that it is not less than one year.

33. ProWorksite commercial warranty

ProWorksite provides a 12-month commercial warranty for refurbished products, in accordance with the conditions stated on the Warranty page.

The commercial warranty does not replace, exclude or limit the statutory guarantee applicable to consumers.

Coverage may include:

  • electrical defects;
  • malfunctions that prevent proper use;
  • technical problems not resulting from misuse or normal wear and tear.

Where a covered problem occurs, ProWorksite may repair the product or, where repair is impossible or unreasonable, replace it with an equivalent product.

34. Lack of conformity

A product may be non-conforming where, for example, it:

  • does not correspond to its description;
  • does not have the stated characteristics;
  • is not suitable for its normal intended use;
  • is delivered without the promised accessories;
  • has an original defect that impairs its operation;
  • is different from the product ordered.

The consumer must contact ProWorksite, describe the problem and provide, where reasonably necessary:

  • the order number;
  • photographs;
  • videos;
  • the serial number;
  • a description of the defect;
  • information on the conditions of use.

In the event of a lack of conformity, the consumer may be entitled to repair or replacement free of charge and, in the cases provided by law, to a price reduction or termination of the contract.

35. Warranty exclusions

Without prejudice to the consumer’s mandatory rights, the following are not normally covered:

  • normal wear and tear;
  • damage caused by a fall or impact;
  • improper use;
  • overloading or overheating caused by use;
  • contact with water, liquids or incompatible substances;
  • insufficient or incorrect maintenance;
  • use contrary to the manufacturer’s instructions;
  • unauthorised modifications or repairs;
  • use of incompatible components;
  • removal or alteration of the serial number;
  • ordinary wear of blades, discs, bits, brushes and other consumable components;
  • the natural reduction in battery capacity caused by use, charging cycles and ageing;
  • cosmetic defects already disclosed for used or refurbished products.

The exclusion does not apply where the damage results from an original defect covered by the statutory guarantee.

36. Repair and replacement

The customer must not send a defective product without first contacting ProWorksite, unless this is necessary to exercise a mandatory right.

ProWorksite may request a preliminary assessment using photographs, videos or technical descriptions.

Where the problem is covered:

  • return instructions will be provided;
  • the necessary costs will not be charged to the consumer;
  • the product will be examined;
  • the product will be repaired or replaced, where applicable.

The replacement product may be a refurbished item with equivalent characteristics and value, where this is consistent with the product originally purchased and the customer’s rights.

37. Business customers

The 14-day right of withdrawal available to consumers does not automatically apply to business purchases.

Returns due to a change of mind by professional customers must be authorised by ProWorksite in writing.

Business purchases are governed by:

  • the relevant civil and commercial law;
  • the conditions stated on the product page;
  • any commercial warranty;
  • any specific agreements entered into by the parties.

The business customer must verify that the product is suitable for their professional requirements and compatible with the equipment used.

38. Limitations of liability

ProWorksite is not liable for damage caused by:

  • improper use of the product;
  • failure to follow instructions;
  • unauthorised work;
  • incompatible accessories or components;
  • incorrect information supplied by the customer;
  • temporary website outages not resulting from serious fault on the seller’s part;
  • unforeseeable events or events not reasonably within its control.

Nothing in these terms limits liability that cannot be excluded by law or the consumer’s mandatory rights.

39. Force majeure

ProWorksite is not liable for delays or temporary inability to perform caused by events outside its reasonable control, such as:

  • natural disasters;
  • exceptional weather events;
  • fires;
  • wars or civil unrest;
  • general strikes;
  • actions by public authorities;
  • transport disruptions;
  • widespread unavailability of IT systems;
  • public health emergencies;
  • other force majeure events.

ProWorksite will inform the customer as soon as possible and take reasonable measures to limit the effects of the event.

Any mandatory rights applicable in the event of failed delivery or permanent impossibility of performance remain unaffected.

40. Customer account

The customer is responsible for keeping their login credentials confidential and for activity carried out through their account.

The customer must promptly inform ProWorksite in the event of:

  • unauthorised access;
  • loss of login credentials;
  • suspicious use;
  • incorrect or outdated information.

ProWorksite may suspend an account where there are reasonable grounds relating to security, fraud or breach of these terms.

41. Intellectual property

The website’s text, photographs, graphic elements, logos, descriptions, layout and content belong to ProWorksite or are used under authorisations and licences.

Such content may not be copied, reproduced, distributed or used commercially without authorisation, except where permitted by law.

Manufacturer and payment-provider trademarks belong to their respective owners.

42. Personal data protection

Personal data is processed in accordance with the Privacy Policy published on the website.

Information about cookies and tracking technologies is available in the cookie banner and any applicable Cookie Policy.

A purchase does not automatically constitute consent to receive promotional communications.

43. Communications

Communications relating to orders may be sent by:

  • email;
  • telephone;
  • WhatsApp, where used by the customer;
  • website notifications;
  • Shopify systems;
  • carrier notifications.

The customer must keep their contact details up to date and also check their spam folder.

44. Complaints and customer support

For complaints, requests or assistance, the customer may contact:

The request should include:

  • the customer’s name;
  • the order number;
  • a description of the problem;
  • any useful photographs or documents.

ProWorksite endeavours to respond to and handle the request within a reasonable time.

45. Alternative dispute resolution

Consumers may use alternative dispute resolution bodies recognised under applicable law.

ProWorksite may participate in an out-of-court procedure where required by law, agreed with the customer or considered useful in attempting to reach an amicable solution.

The former European ODR platform should not be referenced in these terms: the regulation establishing it was repealed with effect from July 20, 2025, and the submission of new complaints had already ended on March 20, 2025.

46. Governing law

These terms are governed by Italian law.

Where the customer is a consumer residing in another country, the choice of Italian law does not deprive them of any mandatory protections granted by the law applicable in their country of residence.

47. Jurisdiction

Disputes with consumers are subject to the jurisdiction determined by applicable mandatory rules and, where provided, the courts of the consumer’s place of residence or domicile.

Exclusive jurisdiction of the Court of Terni is not imposed on consumers.

For disputes with business customers, unless otherwise agreed in writing or subject to mandatory jurisdiction, the courts of Terni have exclusive jurisdiction.

Clauses that unlawfully derogate from the consumer’s court of jurisdiction may be regarded as unfair and unenforceable.

48. Severability

If any provision of these terms is declared void, ineffective or unenforceable, the remaining provisions remain valid.

The affected clause will be interpreted or replaced to the extent necessary to make it compliant with the law and its original purpose.

49. Failure to exercise a right

A failure or delay by ProWorksite in exercising a right does not constitute a waiver of that right.

Any tolerance of one breach does not constitute acceptance of subsequent breaches.

This provision does not limit the consumer’s mandatory rights.

50. Changes to these terms

ProWorksite may update these terms to reflect:

  • changes in legislation;
  • changes to products or services;
  • new payment methods;
  • logistical changes;
  • platform developments;
  • organisational requirements.

Each order is governed by the terms available and accepted at the time of purchase.

Subsequent changes do not apply retroactively to orders already concluded unless they are more favourable to the customer or required by law.

51. Priority of specific terms

Any specific terms stated on the product page, in a commercial offer or in a written agreement supplement these terms.

In the event of any conflict:

  • mandatory provisions of law prevail;
  • followed by any specific terms expressly accepted;
  • and finally these general terms apply.
